Clear rules before any site goes live.

Please read these Terms carefully. By using this website, requesting a mini-brief, reviewing a proposal, approving a draft, paying an invoice, or otherwise working with Main Ave Design, you agree to these Terms. If you are accepting for a business, you confirm that you are authorized to bind that business.

These Terms are written to set practical service boundaries. They are not a substitute for advice from a licensed attorney. If your project has special legal, compliance, privacy, accessibility, tax, health, age-restricted, regulated-product, or industry obligations, you are responsible for getting qualified professional review before approval or publication.

1. Services and relationship

Main Ave Design provides website strategy, design, static-site development, copy support, demo concepts, intake review, proposal support, and related website-care services for local businesses. Unless a signed written agreement says otherwise, services are provided as independent contractor services and do not create a partnership, joint venture, employment relationship, franchise, agency relationship, or fiduciary relationship.

Project scope, deliverables, timing, price, revision limits, hosting responsibilities, and maintenance responsibilities are defined by the written proposal, invoice, message thread, or scope document approved for that project. Anything not listed in the approved scope is outside scope and may require a separate quote.

2. Drafts, approvals, and no-surprises boundary

Work may include drafts, concepts, mockups, fictional demos, private previews, or suggested copy. Drafts are for review only. No client website, DNS change, domain connection, payment setup, outreach message, or public launch is authorized until the specific action is approved in writing.

You are responsible for reviewing all names, addresses, phone numbers, prices, claims, policies, menus, services, hours, regulated-product statements, legal pages, accessibility needs, and other business information before approval. Approval means you have reviewed the material and authorize Main Ave Design to use it for the approved purpose.

Reasonable corrections for mistakes made by Main Ave Design are included. New features, major layout changes after approval, additional pages, rush requests, new integrations, copy rewrites caused by missing client information, and requests beyond the approved scope may require additional fees.

3. Client content, rights, and accuracy

You retain ownership of materials you provide, such as logos, photos, product information, menus, service descriptions, policies, testimonials, and brand assets. You grant Main Ave Design a non-exclusive license to use, edit, resize, format, publish, and display those materials as needed to perform the approved work.

You promise that you have the rights and permissions needed for any materials you provide and that the information is accurate, lawful, and not misleading. You are responsible for claims about your business, prices, offers, credentials, licenses, results, testimonials, before-and-after photos, health/safety statements, age-restricted goods, and regulated products or services.

Main Ave Design may use reusable know-how, layout patterns, code techniques, scripts, checklists, non-client-specific components, and general design methods across projects. Final client-specific deliverables may not be copied, resold, or used to misrepresent authorship except as allowed by the approved project terms.

4. Pricing, payment, refunds, and pause rights

Prices are stated in the approved quote, invoice, or written offer. Unless otherwise agreed, payment is due before publication, handoff, or final file delivery. Recurring care plans, if any, renew on the cadence stated in the accepted offer and may be paused or ended according to that offer.

Deposits, setup fees, rush fees, research time, strategy work, draft work, and completed custom work may be non-refundable once work begins, unless a written offer says otherwise. If a project is cancelled after work has started, Main Ave Design may invoice for completed work, approved expenses, and time spent up to cancellation.

Main Ave Design may pause work, withhold launch, withhold handoff, or suspend maintenance if payment is late, required client information is missing, approval is withheld, or the requested work creates legal, platform, security, spam, or compliance risk.

5. Publishing, hosting, maintenance, and demos

Unless a maintenance plan or written hosting scope says otherwise, Main Ave Design is not responsible for long-term hosting, domain renewal, DNS renewal, third-party account access, uptime, plugin/platform updates, email deliverability, analytics retention, search ranking, ad performance, or ongoing changes after handoff.

Static sites may be deployed through third-party providers such as Cloudflare Pages or another approved host. Publishing depends on provider availability, account permissions, DNS propagation, SSL issuance, platform policies, and information supplied by the client.

Fictional demos are portfolio proof assets. They are not real clients, endorsements, offers, or operating businesses. Demo names, visuals, and scenarios may be fictional or illustrative. Demos should not be treated as legal, compliance, accessibility, or industry advice.

6. Third-party tools and external services

Websites and workflows may rely on third-party services such as domain registrars, DNS providers, hosting providers, email providers, form processors, analytics tools, maps, fonts, payment processors, calendars, booking systems, social platforms, or embedded content providers. Main Ave Design does not control those providers and is not responsible for their downtime, policy changes, pricing changes, data handling, errors, security incidents, or account restrictions.

You are responsible for reviewing and complying with any third-party terms that apply to your business. If you ask Main Ave Design to connect a third-party account, you remain responsible for account ownership, billing, credentials, permissions, and provider compliance.

7. Prohibited uses and regulated business safeguards

You may not use Main Ave Design services to publish unlawful, deceptive, infringing, harassing, exploitative, spam-related, malware-related, or rights-violating material. Main Ave Design may refuse or stop work that appears unsafe, unlawful, misleading, platform-violating, or outside its ability to support responsibly.

Businesses involving age-restricted products, alcohol, tobacco, vape, cannabis, adult-oriented products, health claims, financial services, legal services, medical services, supplements, weapons, contests, employment, housing, or other regulated areas are responsible for their own licensing, disclosures, age gates, disclaimers, advertising rules, privacy rules, recordkeeping, and legal review. Main Ave Design does not provide legal, tax, medical, financial, or regulatory advice.

8. Privacy, security, and data limits

Personal information is handled according to the Privacy Policy. No website or internet transmission is perfectly secure. Main Ave Design uses practical safeguards but cannot promise uninterrupted availability, error-free operation, or complete security.

Do not send passwords, payment card numbers, private customer lists, health data, government IDs, or other sensitive information through ordinary website forms or email unless a secure method has been specifically approved for that purpose.

9. Disclaimers

Services and website materials are provided on an “as is” and “as available” basis to the fullest extent allowed by law. Main Ave Design does not promise search ranking, traffic, sales, revenue, appointments, conversions, platform approval, uninterrupted hosting, error-free operation, or any specific business outcome.

You are responsible for final business, legal, compliance, accessibility, tax, advertising, and industry review before publication. Main Ave Design can help organize and implement approved materials, but it does not replace licensed professional advice.

10. Limitation of liability and indemnity

To the fullest extent allowed by law, Main Ave Design will not be liable for indirect, incidental, special, consequential, exemplary, punitive, lost-profit, lost-revenue, lost-data, business-interruption, reputational, search-ranking, platform-account, or third-party-service damages.

To the fullest extent allowed by law, Main Ave Design’s total liability for any claim related to the website, services, drafts, proposals, publication, or these Terms is limited to the amount you paid to Main Ave Design for the specific project or service giving rise to the claim during the three months before the claim arose.

You agree to defend, indemnify, and hold harmless Main Ave Design from claims, damages, losses, liabilities, penalties, costs, and expenses, including reasonable attorney fees, arising from materials you provide, instructions you give, your business operations, your products or services, your legal/compliance obligations, your use of the website or deliverables, your third-party accounts, or your breach of these Terms.

11. Governing law, disputes, and severability

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Before filing a formal claim, both sides agree to make a good-faith effort to resolve the issue by written notice and a reasonable opportunity to cure.

Unless a different written agreement applies, any permitted court action must be brought in a state or federal court located in New Jersey, and both sides consent to that venue and jurisdiction. Either side may bring an eligible claim in small claims court. If a part of these Terms is found unenforceable, the remaining parts remain in effect.

12. Changes to these Terms

Main Ave Design may update these Terms from time to time. The effective date shows when the latest version became active. Continued use of the website or services after changes are posted means you accept the updated Terms for future use and future services.
